The Koforidua High Court in the Eastern Region has granted an interim injunction preventing Ernest Kumi, the NPP’s parliamentary candidate, from holding himself out as the Member of Parliament-elect for the Akwatia Constituency. The ruling comes amid an ongoing dispute between the two main political parties, the NDC and NPP, regarding the results of the December 2024 parliamentary election.
Three weeks ago, the Electoral Commission (EC) declared Ernest Kumi as the winner of the election. However, his victory has been contested by Henry Boakye-Yiadom, the NDC’s parliamentary candidate, who filed a lawsuit against the EC, Kumi, and the Clerk to Parliament, seeking an injunction to prevent Kumi’s swearing-in.
Court Issues Injunction
The court order prohibits Ernest Kumi from being recognized as the MP-elect for Akwatia. Specifically, the injunction restrains the respondents, including Kumi, from proceeding to:
- Call, admit, register, swear in, recognize, or gazette Kumi as the elected Member of Parliament for Akwatia.
- Allow Kumi to hold himself out as the Member of Parliament for Akwatia.
The injunction is set to remain in force for 10 days while further legal proceedings continue.

Background of the Dispute
The dispute began after the Electoral Commission declared Ernest Kumi the winner of the election with 19,269 votes, beating Henry Boakye-Yiadom of the NDC, who garnered 17,206 votes. However, concerns arose around the collation of results in the constituency, with both parties alleging discrepancies in the process.
Despite the declaration, tensions have been high in the constituency, traditionally a stronghold for the NPP, now a contested battleground for the NDC.
The Electoral Commission’s declaration was made at the National Police Training School in Tesano, Accra, after multiple failed attempts to finalize results in the Eastern Region.
Court’s Ruling and Next Steps
The ruling by the Koforidua High Court has sparked significant attention, with many now awaiting the next phase of the legal battle. The court’s decision prevents any further actions to swear in Ernest Kumi as the MP-elect until the matter is resolved.

The 10-day injunction provides a temporary reprieve for Henry Boakye-Yiadom and the NDC, who hope the court will rule in their favor in the ongoing challenge to the election results.
Political Implications
The Akwatia Constituency has long been considered a stronghold for the NPP, but the current dispute over the election results underscores the growing political tensions in the region. With the NDC contesting the results, both parties are now focusing on the legal and political ramifications of the court’s decision.
